Please read these terms before purchasing a paid membership. By selecting a paid plan, submitting payment, or using a paid feature, you agree to these terms, the High Cheese Terms of Service, and the Privacy Policy. If you do not agree, do not purchase or use the paid feature.
1. Acceptance and scope
These High Cheese Purchaser Terms apply to purchases and use of paid memberships and other paid features offered through the High Cheese website or mobile application. They supplement the general rules in the High Cheese Terms of Service.
High Cheese may offer a free Rookie membership and paid Veteran, All-Star, Hall-of-Fame, or other membership levels. The features, price, billing interval, and purchase terms presented at checkout are part of your order.
2. Eligibility and authority
You must be at least 18 years old to create an account, purchase a paid membership, or use paid High Cheese features. You may not purchase a membership for someone who is not eligible to use High Cheese.
If you purchase on behalf of a team, league, organization, or other entity, you represent that you are authorized to accept these terms and make the purchase for that entity. You are responsible for ensuring that people who use the purchased access follow these terms.
3. Memberships and features
A membership gives the account that purchased it access to the features included with the selected level during the applicable membership period. High Cheese may describe included features on the membership page, in the checkout flow, or in an order confirmation.
Membership access does not transfer ownership of High Cheese, its software, trademarks, or platform content to you. A membership also does not automatically grant authority to act for a player, manager, front-office user, team, league, or organization. Access and permissions remain subject to the account role and the authorization associated with the relevant baseball record.
High Cheese may impose reasonable limits on use of a feature to protect the service, other users, data integrity, or security.
4. Orders, billing, and renewal
Before you complete a purchase, High Cheese will show the applicable price, currency, billing interval, taxes or other charges that we can reasonably identify, and any material purchase conditions. You authorize High Cheese and Stripe to charge your selected payment method for the amount shown at checkout.
Stripe processes payment information and payment transactions for High Cheese. Stripe may collect and process information needed to authorize, settle, secure, and support a payment. For information about how Stripe handles payment data, see the Stripe Privacy Policy. High Cheese does not ask you to send complete payment-card numbers or authentication credentials by email.
For a recurring membership, you authorize recurring charges at the start of each renewal period until you cancel. An annual plan is charged for the full annual amount even if the price is displayed as a monthly equivalent. You are responsible for keeping your payment and account information accurate and current.
If a payment is declined, reversed, disputed, or otherwise not received, High Cheese may suspend paid access, retry the payment, or cancel the affected membership. You remain responsible for amounts properly owed before cancellation.
5. Cancellation and refunds
You may cancel a recurring membership before the next renewal through the account or purchase-management flow made available to you, or by contacting [email protected]. Cancellation stops future renewals; unless stated otherwise at checkout, access continues through the period already paid for.
Payments are non-refundable and non-transferable except where a refund is expressly offered by High Cheese or required by applicable law. We do not provide partial-period refunds for unused time, unused features, account closure, or a change in membership level unless applicable law requires otherwise.
If you believe a charge was made in error, contact High Cheese promptly with the account email, charge date, and a description of the issue.
6. Changes to these terms and services
High Cheese may revise these terms for operational, technical, business, security, or legal reasons. We will post the current version on this page and may provide notice of material changes through the service or the email associated with your account.
Changes will not retroactively alter a completed purchase unless required by law. If you do not agree to a material change, you may stop using the affected paid feature and cancel before the next renewal. Continued use after the effective date means you accept the revised terms.
High Cheese may add, modify, limit, suspend, or discontinue features. We will not be responsible for a change, suspension, or discontinuation to the extent permitted by law, except for obligations that cannot legally be excluded.
7. Accounts and role separation
You are responsible for your account credentials and activity. Do not share credentials, allow unauthorized purchases, or use another person’s account. Notify High Cheese promptly if you believe your account or payment method has been compromised.
Membership access and baseball permissions are separate. A paid membership does not let a player perform manager actions, let a manager perform league-officer actions, or let any account act for a team or league without the required assignment or authorization.
8. User content and acceptable use
You keep ownership of content you submit to High Cheese. You give High Cheese the limited license needed to host, display, process, and distribute that content through the features you use. You represent that you have the rights and permissions needed to submit the content.
You may not use a paid feature to:
- impersonate a person, team, league, or organization;
- harass, threaten, defraud, or exploit another user;
- upload unlawful, infringing, malicious, or deceptive content;
- scrape, copy, sell, or systematically export High Cheese data without permission;
- probe, disrupt, overload, reverse engineer, or bypass controls on the service; or
- use paid access to build a competing service or database.
9. Teams, leagues, and baseball activity
High Cheese provides software and information tools for players, teams, leagues, tournaments, schedules, and baseball organizations. High Cheese does not organize, supervise, officiate, insure, or guarantee any real-world game, tournament, practice, travel, league, or other baseball activity unless we expressly say otherwise in writing.
You are responsible for evaluating the safety, rules, eligibility, costs, insurance, facilities, organizers, and participants of any activity you join or arrange. Baseball and related travel or activities carry risks, including injury, property loss, disputes, and cancellation. You participate and arrange activities at your own risk.
10. Suspension and termination
High Cheese may suspend or terminate paid access or an account when reasonably necessary to address a violation of these terms, nonpayment, fraud, security concerns, legal requirements, harm to other users, or a threat to the service. High Cheese may also discontinue a paid feature or membership level.
If access is terminated because you violated these terms or created a security, legal, or payment risk, you are not entitled to a refund except where applicable law requires one. Sections that by their nature should continue after termination will remain effective, including ownership, acceptable use, disclaimers, liability limits, and dispute provisions.
11. Disclaimers and liability
To the maximum extent permitted by law, High Cheese and its paid features are provided on an “as is” and “as available” basis. High Cheese does not guarantee that the service or a paid feature will be uninterrupted, secure, error-free, complete, accurate, or available at all times.
To the maximum extent permitted by law, High Cheese will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities arising from your use of or inability to use a paid feature.
To the maximum extent permitted by law, High Cheese’s total liability for claims arising from a paid feature will not exceed the greater of the amount you paid High Cheese for that feature during the six months before the event giving rise to the claim or one hundred U.S. dollars. Nothing in these terms excludes liability that cannot legally be excluded or limited.
12. Dispute resolution
If you have a concern or dispute about a paid feature, contact [email protected] first and provide enough information for High Cheese to investigate. You and High Cheese agree to make a good-faith effort to resolve the issue informally before starting a formal proceeding, unless urgent relief or applicable law allows otherwise.
These terms do not remove or reduce rights or remedies that cannot be waived under the law that applies to you.
13. General terms
These purchaser terms, the purchase details shown at checkout, the High Cheese Terms of Service, and the High Cheese Privacy Policy form the agreement about paid features. If a provision is found unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver of the right to enforce it later.
You may not transfer a paid membership or your obligations under these terms without High Cheese’s written permission. High Cheese may assign these terms as part of a reorganization, merger, acquisition, financing, or transfer of the relevant business or assets.
The English version of these terms controls if a translation differs. Headings are for convenience and do not change the meaning of the terms.
